The Following User Agreement (the "Agreement", "User Agreement" and/or "terms") explain the terms on which you can access the use of our site and services.

This Agreement is effective on November 18th, 2010 for current users, and upon acceptance for new registering users. The previous amendment to this Agreement was effective for all users on October 11th, 2007.

Eligibility of Membership

This auction site ( ) is only available to people who are legally able to form binding contracts with you and the seller and/or buyer. Users who are under the age of 18 or suspended USiFF® members are not eligible for membership. If you are under the age of 18, you may use our service in conjunction with the supervision of your parents or a legal guardians. If you do not meet these requirements, you are not eligible to use our site or services.

You agree to provide accurate registration information regarding your name, address, phone number and email address., Inc.may, at its sole discretion, suspend any account that is found to contain invalid information. Your USiFF® account can not be sold or transferred to a third party.

VERIFIED USiFF MEMBERS: USiFF® is continuing to work to ensure that all members become apart of the Verified USiFF® Users Program (VUUP). This program will provide users on USiFF® with the most advanced fraud free auction environment. We want you to enjoy the auction experience, not worry if your item will or will not ship.

USiFF Online Auctions is a web site, we are not an Auctioneer. Service that ( ) is providing is an Internet auction service. We only provide services to people interested in selling and buying merchandise via an Internet auctions or stores. We do not have control over the items that are posted in the auction site, and cannot guarantee the authenticity and quality of a said product. We are not responsible for the actions the sellers take, before, during and after the auction, typographical errors, misprints, loss of merchandise/money, or damage/ failure of equipment, due to your visit to this auction site.

Use of this site is at your own risk and content is presented 'As-Is'.

Sign-up credit

Your Sign-up Auction credit(s) have no monetary value. This credit can only be used for advertising, auctioning upgrades and paying your buyer transaction fee(s).

Service Fees

Joining USiFF® and listing items is free. We charge fees for auction upgrades. These auction upgrade fees are only charged when an item sells successfully. We charge a fee to the winning bidder (sellers have the option of paying this fee during the listing process), we charge fees for our stores, we also charge a fee to allow our members to get verified. You always have the opportunity to review these fees before you are charged. You can always review the fees and our credit policy at anytime in this Agreement. We may change our Fees from time to time. Any changes to our fees or credit policy are effective 15 days after we post these changes on the site. We have the right to lower fees at anytime for promotional and seasonal events. These lower fees and promotional events are effective when we post them on our site. All fees and services are in U.S. Dollars and you are responsible for paying all fees associated with your USiFF® account. You are also responsible for paying all applicable taxes.

Bidding and Selling - As a user, you may bid and/or sell merchandise using

A. As a bidder - you know that placing a bid is a binding contract between you and the seller, and the bid cannot be retracted unless due to mistake by the seller, of typographical error, or other error, due to human error on the seller's part. Once you place a bid, and if you win, you will be obligated to buy the product at the said price you indicated as your bid. Placing a bid on this auction site, winning, then not paying for the product is illegal in most states, resulting in possible prosecution

B. As a seller - the item that you place up for bids must be real. Pre-sales are not accepted. USiFF ® will not tolerate the listing of counterfeit, replica, or unauthorized items.

Once a bid has been placed for your item, you are entering into a binding contract with the potential buyer of the product, if that bid shall be the highest bid. Once the auction is over, if over reserve price, you are obligated to sell to the potential buyer which is the highest bidder in your auction. If reserve price was not met, you are not obligated in any way to sell this item at all.

As a seller, you are not legally permitted to engage in any of these activities which construes fraud, including but not limited to:

Non-delivery: involves the seller placing an item up for bid when, in fact, there is either no item at all or the seller has no intention to sell. As a result, the item is never delivered to the buyer after he/she purchases the item.

Misrepresentation: Occurs when the seller's purpose is to deceive the buyer as to the true value of an item by listing false information or using fake pictures of the item.

Non-payment: Involves a buyer placing the highest bid and winning the auction, and as the merchandise is delivered no money is paid. The victim in this case is actually the seller.

Triangulation: Involves three parties: the perpetrator, a consumer, and an online merchant. The perpetrator buys merchandise from an online merchant using stolen identities and credit card numbers. Then, the perpetrator sells the merchandise at online auction sites to unsuspecting buyers. Later, the police seize the stolen merchandise to keep for evidence, and the buyer and merchant end up the victims.

Fee stacking: Involves adding hidden charges to the item after the auction is over to obtain more money. Instead of a flat rate for postage and handling, the seller adds separate charges for postage, handling, and shipping. As a result, the buyer has to pay more than anticipated. As we stated before, you shouldn't be making money on shipping.

Black-market goods: These goods include copied software, music CDs, videos, etc. The goods are delivered without a box, warranty, or instructions. Any violations of unauthorized copy policy will result in the suspension of your account. For more information about copyright protection, visit the U. S. Copyright Office

Multiple bidding: This occurs when a buyer places multiple bids (some high and some low) using different aliases. The multiple high bids cause the price to escalate and scares off other potential buyers from bidding. Then, in the last few minutes of the auction, the same buyer withdraws their high bids, only to purchase the item with their lowest bid. On USiFF Online Auctions, it is not permitted to use secondary User IDs or other USiFF® members to artificially raise the level of bidding and/or price of an item. Equally, retracting bids is not allowed as a rule on USiFF, as all bids are binding, except: sales of real estate or businesses, sales of items that are prohibited by law or by USiFF's User Agreement, and other exceptional circumstances (typographical errors, significant change in the description of the item, inability to reach the seller, and unauthorized use of the buyer's ID and password).

Shill bidding: is the intentional sham bidding by the seller to drive up the price of his/her own item that is up for bid. This is accomplished by the sellers themselves and/or someone that is associated with the seller making bids to purposely drive up the price of the seller's item.

Shield bidding: occurs when the buyer uses another email address or a friend (the shield) to drive up prices and discourage bids on an item she wants. At the last minute, the shield withdraws the high bid, allowing the buyer to win the item at a lower price. Most auction sites forbid retracting a bid once it's made, and on USiFF® shill and shield bidding is clearly prohibited.

Although one or more forms may be prevented under the auction site policies, the main concerns for online auction fraud lies in the non-delivery, delivery of defective goods or late delivery, failure to disclose all relevant information, and non-payment. In the second part of this paper some of the anti-fraud measures that could be used to stamp out fraud will be analyzed.

Posting Items

Posting Items - As a member, you are welcome to post items for sale using USiFF auction services or stores. We do have restrictions on what items you may sell and what you may not sell. You may not sell illegal merchandise, including pirated software and music, firearms, or anything that is affiliated with violence, etc. Listings that do not offer an item or service for sale are not permitted. Items that are up to bids are subject to review by the staff of USiFF , and may be removed without prior notice, if found in violation with the User Agreement.

We gather your information so that other people will have it on hand when they win your auction or you win their auction. Personal information is not sold or rented. Personal information sent to a user regarding a product bought or sold on the auction is not to be used for any other purpose, except for communication concerning the auction item.

In the event that a dispute arises, USiFF's goal is to provide you with an effective means of resolving disputes. Before seeking alternatives, we encourage you to first contact USiFF directly to seek a resolution and we will work to resolve the disputes as quickly as possible. If we are unable to resolve your dispute, we encourage you to report all user-to-user disputes to your local law enforcement, postmaster general, or a certified mediation or arbitration entity.

Legal Compliance

You shall comply with all applicable laws, statutes, ordinances and regulations, domestic and international, regarding your use of our service and your bidding on, listing, purchase, solicitation of offers to purchase, and sale of items.

No Warranty, provides this web site on an 'as-is' condition, that is without a warranty or condition., Inc. is not liable for any damages resulting in an auction, or your visit to the site.

Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other rights that vary from state to state.


These policies may be changed from time to time and will be effective immediately after we post the changes on to the site, except for our Privacy Policy, for which we will provide you with (30) thirty days notice. In addition, when using particular services on our site, you agree that you are subject to any posted policies or rules applicable to these services you use through our site, which may be posted from time to time. All such posted policies and/or rules are hereby incorporated by reference into this agreement.
